PEDUM (PEDOMAN UMUM) PELAYANAN INFORMASI PUBLIK PEJABAT PENGELOLA INFORMASI DAN DOKUMENTASI ( PPID ) PEMBANTU KELURAHAN PANGONGANGAN

  1. PENDAHULUAN.

A. LATAR BELAKANG

              Informasi merupakan kebutuhan pokok setiap orang bagi pengembangan pribadi dan lingkungan sosialnya serta merupakan bagian penting bagi ketahanan nasional. Hak memperoleh informasi merupakan hak asasi manusia dan keterbukaan informasi publik merupakan salah satu ciri penting negara demokratis yang menjunjung tinggi kedaulatan rakyat untuk mewujudkan penyelenggaraan negara yang baik. Pemberlakuan Undang-Undang Nomor 14 Tahun 2008 tentang Keterbukaan Informasi Publik (UU KIP) . UU ini telah memberikan landasan hukum terhadap hak setiap orang untuk memperoleh Informasi Publik. Dimana, setiap Badan Publik mempunyai kewajiban dalam menyediakan dan melayani permohonan Informasi Publik secara cepat, tepat waktu, biaya ringan dan cara sederhana. Salah satu tugas Pejabat Pengelola Informasi dan Dokumentasi (PPID) menyediakan akses informasi publik bagi pemohon informasi. Terkait dengan tugas tersebut, PPID menetapkan standar layanan informasi di lingkungan PPID Kelurahan Pangongangan. Dengan adanya Standar Operasional Pelayanan Informasi Publik ini, diharapkan implementasi UU KIP dapat berjalan efektif dan hak-hak publik terhadap informasi yang berkualitas dapat secara nyata terpenuhi.

B. LANDASAN HUKUM

  1. Undang-Undang Nomor 14 Tahun 2008 tentang Keterbukaan Informasi Publik (Lembaran Negara Republik Indonesia Tahun 2008 Nomor 61, Tambahan Lembaran Negara Nomor 4846);
  2. Undang-Undang Nomor 25 Tahun 2009 tentang Pelayanan Publik (Lembaran Negara RI Tahun 2009 Nomor 112, Tambahan Lembaran Negara Nomor 5038);
  3. Undang-Undang Nomor 43 Tahun 2009 tentang Kearsipan (Lembaran Negara Republik Indonesia Tahun 2009 Nomor 152, Tambahan Lembaran Negara Nomor 5071);

  13. Peraturan Daerah Kota Madiun Nomor 3 Tahun 2016 tentang Pembentukan dan Susunan Perangkat Daerah
  14. Keputusan Walikota Madiun Nomor 042-401.109/21/2017 tentang Pembentukan Layanan Informasi dan Dokumentasi dan Penunjukan Pejabat Pengelola Informasi dan Dokumentasi dilingkungan Pemerintahh Kota Madiun.

C. MAKSUD DAN TUJUAN

1. Maksud :

Pedoman ini sebagai acuan mengenai ruang lingkup, tanggungjawab dan wewenang Pejabat Pengelola Informasi dan Dokumentasi (PPID) Kelurahan Pangongangan (Sekretariat PPID Kelurahan Pangongangan) dalam menyediakan informasi tertentu melalui mekanisme pelaksanaan kegiatan Pelayanan Informasi Publik.

2. Tujuan :

 – Mendorong terwujudnya implementai UU KIP secara efektif dan hak-hak  publik terhadap   informasi yang berkualitas dapat terpenuhi ;

–  Memberikan standar bagi Pejabat PPID dalam melaksanakan pelayanan Informasi Publik;

– Meningkatkan pelayanan Informasi Publik di lingkungan Organisasi/Lembaga Publik untuk menghasilkan layanan Informasi Publik yang berkualitas

II. HAKEKAT PELAYANAN INFORMASI PUBLIK

            Hakekat Pelayanan Informasi Publik adalah pemberian pelayanan kepada pemohon Informasi Publik secara cepat, tepat waktu, biaya ringan/proporsional, dan cara sederhana; pengecualian Informasi Publik bersifat ketat dan terbatas; kewajiban Badan Publik untuk membenahi sistem dokumentasi dan pelayanan informasi.

III.  ASAS PELAYANAN INFORMASI PUBLIK

1. Transparansi

Bersifat terbuka, mudah dan dapat diakses oleh semua pihak yang membutuhkan dan disediakan secara memadai serta mudah dimengerti.

2. Akuntabilitas

Dapat dipertanggungjawabkan sesuai dengan ketentuan peraturan perundang-undangan.

3. Kondisional

Sesuai dengan kondisi dan kemampuan pemberi dan penerima pelayanan dengan tetap berpegang pada prinsip efisiensi dan efektivitas

4. Partisipatif

Mendorong peran serta masyarakat dalam penyelenggaraan pelayanan informasi publik dengan memperhatikan aspirasi, kebutuhan dan harapan masyarakat.

5. Kesamaan Hak

Tidak Diskriminatif dalam arti tidak membedakan suku, ras, agama, golongan, gender dan status ekonomi

6. Keseimbangan hak dan kewajiban

Pemberi dan penerima pelayanan publik harus memenuhi hak dan kewajiban masing-masing pihak.

IV. KELOMPOK PELAYANAN INFORMASI PUBLIK

         Pelayanan Informasi Publik yang dilaksanakan oleh Pejabat Pengelola Informasi dan Dokumentasi Badan Publik Pemerintah dan Non Pemerintah di lingkungan Pemerintah Kelurahan Pangongangan, masuk dalam kelompok pelayanan jasa, yakni menyediakan berbagai hal yang berkaitan dengan informasi dan komunikasi yang dibutuhkan oleh masyarakat.

V. STANDART OPERASIONAL PELAYANAN (SOP) INFORMASI PUBLIK

             Setiap penyelenggara pelayanan publik sesuai dengan masing-masing tugas dan fungsinya harus memiliki standart pelayanan yang berkaitan dengan prosedur dan waktu sebagai ukuran baku untuk penyelenggaraan pelayanan publik dan wajib ditaati oleh pemberi dan penerima pelayanan informasi.

Adapun Standar Pelayanan Informasi Publik, sbb :

1. OPERASIONAL PELAYANAN INFORMASI PUBLIK

Untuk melaksanakan pelayanan informasi perlu didukung oleh Front Office dan back Office yang baik :

a. Front Office meliputi : > Desk Layanan Langsung
> Desk Layanan Via Media

b. Back Office, meliputi :> Bidang Pelayanan dan Dokumentasi Informasi
> Bidang Pengolahan Data dan Klasifikasi  Informasi
> Bidang Penyelesaian Sengketa Informasi .

2. DESK INFORMASI PUBLIK

Untuk memenuhi dan melayani permintaan dan kebutuhan pemohon/pengguna informasi publik, Pejabat Pengelola Informasi dan Dokumentasi melalui desk layanan informasi publik melakukan layanan langsung dan layanan melalui media antara lain menggunakan telepon/fax, email dan website (online).

3. WAKTU PELAYANAN INFORMASI

Dalam memberikan layanan informasi kepada pemohon informasi PPID menetapkan waktu pemberian Pelayanan Informasi Publik. di PPID Kelurahan Pangongangan (Sekretariat PPID Kelurahhan Pangongangan ), penyelenggaraan Pelayanan Informasi Publik dilaksanakan pada hari kerja Senin sampai dengan Jumat.

Senin – Kamis          : 07.00 – 15.00 WIB
Istirahat                     : 12.00 – 13.00 WIB
Jumat                         : 07.00 – 14.00 WIB
Istirahat                    : 11.00 – 13.00 WIB

4. MEKANISME PERMOHONAN DAN PELAYANAN INFORMASI PUBLIK

Untuk memenuhi dan melayani permintaan dan kebutuhan pemohon/pengguna informasi publik, PPID melalui desk layanan informasi publik, memberikan layanan langsung dan layanan melalui media cetak dan elektronik (website) :

a. Layanan informasi secara langsung, yaitu layanan informasi publik yang   dikategorikan wajib tersedia setiap saat, dengan mekanisme pelayanan sebagai berikut:

1). Pemohon informasi datang ke desk layanan informasi mengisi formulir permintaan informasi dengan melampirkan foto copy KTP pemohon dan pengguna informasi, bagi lembaga publik/ormas dilengkapi foto copy akta pendirian yang dikeluarkan oleh Kementerian Hukum dan Hak Asasi Manusia (Kemen Hum dan Ham) , surat keterangan terdaftar di Bakesbangpol Provinsi Jawa Timur/setempat, surat keterangan domisili, serta AD /ART lembaga publik/ormas. Maksud dan tujuan permintaan informasi harus jelas penggunaannya / logis serta materi atau informasi yang diminta maksimal 2 (dua) tahun anggaran dan berlaku mundur dari tahun anggaran yang sedang berjalan.

2). Petugas memberikan tanda bukti penerimaan permintaan informasi publik kepada pemohon informasi publik, setelah persayaratan permohonan dilengkapi atau dinyatakan lengkap

3). Petugas memproses permintaan pemohon informasi publik sesuai dengan formulir permintaan informasi publik yang telah ditandatangani oleh pemohon informasi publik.

4). Petugas menyerahkan informasi sesuai dengan yang diminta oleh pemohon/pengguna informasi. Jika informasi yang diminta masuk dalam kategori dikecualikan, PPID menyampaikan alasan sesuai dengan ketentuan peraturan perundangan yang berlaku

5). Petugas memberikan Tanda Bukti Penyerahan Informasi Publik (berita acara penerimaan informasi publik) kepada Pengguna Informasi Publik .

6). Petugas membukukan dan mencatat permohonan informasi publik yang masuk tersebut.

b. Layanan informasi melalui media baik online maupun cetak, yaitu informasi publik yang tersedia dan diumumkan secara berkala dilayani melalui website resmi Kota Madiun atau website masing masing SKPD dan media cetak yang tersedia.

5. JANGKA WAKTU PENYELESAIAN

a. Proses penyelesaian untuk memenuhi permintaan pemohon informasi publik dilakukan setelah pemohon informasi publik memenuhi persyaratan yang telah ditentukan;

b. Waktu penyelesaian dilaksanakan paling lambat 10 (sepuluh) hari kerja sejak diterima permintaan, Pejabat Pengelola Informasi dan Dokumentasi (PPID) akan menyampaikan pemberitahuan yang berisikan informasi yang diminta berada dibawah penguasaannya atau tidak. Dan PPID dapat memperpanjang waktu paling lambat 7 (tujuh) hari kerja.

c. Penyampaian/pendistribusian/penyerahan informasi publik kepada pemohon informasi publik dilakukan secara langsung, dengan menandatangani berita acara penerimaan informasi publik.

d. Jika permohonan informasi diterima, maka dalam surat pemberitahuan juga dicantumkan materi informasi yang diberikan, format informasi , dalam bentuk hard copy atau data tertulis. Apabila dibutuhkan biaya untuk keperluan penggandaan menjadi tanggungjawab atau beban pemohon informasi . Bila permintaan informasi ditolak, maka dalam surat pemberitahuan dicantumkan alasan penolakan berdasarkan UU KIP.

6. BIAYA/TARIF

            Pejabat Pengelola Informasi dan Dokumentasi menyediakan informasi publik secara gratis (tidak dipungut biaya), sedangkan untuk penggandaan , pemohon/pengguna informasi publik dapat melakukan penggandaan/fotocopy sendiri disekitar Kantor Badan Publik (PPID) setempat atau biaya penggandaan ditanggung oleh Pemohon Informasi

7. KOMPETENSI PELAKSANA LAYANAN INFORMASI PUBLIK

         Pejabat Pengelola Informasi dan Dokumentasi dalam melaksanakan pelayanan informasi publik kepada pemohon/pengguna informasi publik dibantu oleh Pejabat Fungsional Arsiparis, Pustakawan, Pranata Humas, dan Pranata Komputer. Untuk petugas pada desk layanan informasi publik diutamakan yang memiliki kompetensi dibidang pengetahuan mengenai peraturan perundang-undangan keterbukaan informasi publik dan pelayanan publik, keterampilan dan sikap dalam berkomunikasi, sehingga dapat menunjang dalam melaksanakan tugas pelayanan informasi.

8. LAPORAN OPERASIONAL LAYANAN INFORMASI PUBLIK

            Pengelolaan hasil penyelenggaraan pelayanan publik dilakukan melalui pembuatan laporan harian pelaksanaan tugas pelayanan informasi publik. Petugas pelayanan informasi publik setiap hari membuat laporan hasil pelaksanaan tugas pelayanan informasi publik disampaikan kepada Bidang Pelayanan Informasi. Bidang Pelayanan Informasi (Badan Publik ) membuat laporan bulanan hasil pelaksanaan tugas pelayanan informasi publik untuk disampaikan kepada Pejabat Pengelola Informasi dan Dokumentasi (PPID) Pembantu Kelurahan Pangongangan.
Selanjutnya PPID Pembantu Kelurahan Pangongangan setiap bulan melaporkan kepada Sekretaris Daerah Kota Madiun selaku atasan PPID Utama Kota Madiun. Laporan tersebut memuat informasi mengenai permintaan informasi publik yang sudah dipenuhi, tindak lanjut dari permintaan yang belum dipenuhi, penolakan permintaan informasi publik disertai dengan alasan penolakannya dan waktu diperlukan dalam memenuhi setiap permintaan pemohon informasi sesuai dengan ketentuan yang telah diatur dalam peraturan perundang-undangan.

9. KEBERATAN ATAS PEMBERIAN INFORMASI PUBLIK

           Setiap Pemohon Informasi Publik dapat mengajukan keberatan secara tertulis kepada atasan Pejabat Pengelola Informasi dan Dokumentasi berdasarkan alasan berikut:

a. Penolakan atas permintaan informasi berdasarkan alasan pengecualian sebagaimana dimaksud dalam Pasal 17;

b. Tidak disediakannya informasi berkala sebagaimana dimaksud dlm Pasal 9;

c. Tidak ditanggapinya permintaan informasi;

d. Permintaan informasi ditanggapi tidak sebagaimana yang diminta;

e. Tidak dipenuhinya permintaan informasi;

f. Pengenaan biaya yang tidak wajar; dan/atau

g. Penyampaian informasi yang melebihi waktu yang diatur dalam Undang-undang ini

VI. KEDUDUKAN PPID

Kedudukan dan Penunjukan PPID Pembantu Kelurahan Pangongangan :

a. PPID Pembantu Kelurahan Pangongangan berkedudukan / Sekretariat di Kantor Kelurahan Pangongangan.

b. PPID Pembantu Kelurahan Pangongangan ditetapkan dengan Surat Keputusan Lurah Pangongangan.

c. Ketua PPID Pembantu Kelurahan Pangongangan adalah Sekretaris Kelurahan Pangongangan.

VII. TUGAS DAN FUNGSI

Tugas dan Fungsi PPID Pembantu Kelurahan Pangongangan

T u g a s :

Merencanakan, mengorganisasikan , melaksanakan , mengawasi , mendorong
dan mengevaluasi pelaksanaan kegiatan dan pelayanan informasi di Kelurahan Pangongangan

F u n g s i :

1.Menghimpun informasi publik dari seluruh Masyarakat Kelurahan Pangongangan melalui beberapa fasilitas yang ada ( link/online dan off line )

2.Penataan dan penyimpanan informasi publik yang diperoleh dari seluruh Perangkat Kelurahan Pangongangan

3.Pelaksanaan konsultasi informasi publik yang termasuk dalam kategori dikecualikan dan informasi yang terbuka untuk publik.

4.Pendampingan Penyelesaian sengketa informasi

VIII. MEKANISME PENGUMPULAN, PENGKLASIFIKASIAN,  PENDOKUMENTASIAN DAN PELAYANAN INFORMASI

A. PENGUMPULAN INFORMASI

Beberapa hal yang harus diperhatikan oleh setiap Perangkat Kelurahan Pangongangan dalam kegiatan pengumpulan informasi adalah :

  1. Pengumpulan informasi merupakan aktivitas penghimpunan kegiatan yang telah, sedang dan yang akan dilaksanakan oleh Perangkat Kelurahan Pangongangan
  2. Informasi yang dikumpulkan adalah informasi yang berkualitas dan relevan dengan tugas pokok dan fungsi masing masing Perangkat Kelurahan Pangongangan
  3. Informasi yang dikumpulkan dapat bersumber dari pejabat dan arsip, baik arsip statis maupun dinamis.
  4. Pejabat sebagaimana dimaksud dalam butir 3 merupakan pejabat yang bertanggung jawab dalam pelaksanaan tugas pokok dan fungsi di Satuan Kerjanya, sedangkan arsip statis dan dinamis merupakan arsip yang terkait dengan pelaksanaan tugas pokok dan fungsi Satuan Kerja bersangkutan
  5. Penyediaan informasi dilaksanakan dengan memperhatikan tahapan sebagai berikut :
    1. Mengenali tugas pokok dan fungsi Satuan Kerjanya;
    2. Mendata kegiatan yang dilaksanakan oleh Satuan Kerjanya;
    3. Mendata informasi dan dokumen yang dihasilkan;
    4. Membuat daftar jenis-jenis informasi dan dokumen.
  6. Komponen utama yang perlu disiapkan dalam pengelolaan dan pelayanan informasi dan dokumentasi, meliputi :
  7. . Organisasi/Kelembagaan;
  8. Kebijakan dan Peraturan Daerah terkait;
  9. Sumber Daya Manusia (Struktural dan Fungsional);
  10. Program dan Kegiatan;
  11. Anggaran dan Dokumen Pelaksanaan Anggaran yang meliputi unsur program dan kegiatan;
  12. Sarana dan Prasarana serta Sistem Informasi (IT);
  13. Daftar Informasi Yang Wajib Disediakan dan Diumumkan Secara Berkala;
  14. Daftar Informasi Yang Wajib Diumumkan Secara Serta Merta;
  15. Daftar Informasi Yang Wajib Tersedia Setiap Saat;
  16. Daftar Informasi Yang Dikecualikan.
  1. PENGKLASIFIKASIAN INFORMASI

Dalam proses pengklasifikasian, informasi dibagi menjadi dua kelompok, yaitu informasi yang bersifat publik dan informasi yang dikecualikan :

  1. Informasi yang bersifat publik

Dikelompokkan berdasarkan subyek informasi sesuai dengan tugas pokok, fungsi dan kegiatan setiap satuan kerja, meliputi:

  1. Informasi yang bersifat terbuka, yaitu informasi yang wajib disediakan dan diumumkan secara berkala, meliputi:
  • Profil yang meliputi seperti sejarah singkat, struktur organisasi, tujuan, kedudukan, tugas dan fungsi, program kerja, dan sebagainya;
  • Informasi mengenai kegiatan dan kinerja Pemerintah Perangkat Kelurahan Pangongangan, Laporan Akuntabilitas Kinerja, dan sebagainya.
  • Informasi mengenai laporan keuangan, seperti laporan realisasi anggaran, laporan pendapatan daerah, laporan pertanggungjawaban keuangan, dan sebagainya.
  • Informasi lain yang diatur dalam peraturan perundangan;
  • Informasi yang lebih detail atas permintaan pemohon.
  1. Informasi yang wajib diumumkan secara serta merta, yaitu informasi yang dapat mengancam hajat hidup orang banyak dan ketertiban umum, meliputi:
  • ) Informasi mengenai bencana alam, seperti: daerah potensi tsunami, gunung meletus, tanah longsor, banjir, dan sebagainya.
  • Informasi mengenai limbah berbahaya, seperti: laporan hasil pemeriksaan limbah bahan kimia yang berada di sungai, laut atau daerah pemukiman.
  • Hal lain yang mengancam hajad hidup orang banyak.
  1. Informasi publik yang wajib tersedia setiap saat, meliputi:
  • Daftar seluruh informasi publik yang berada di bawah penguasaan Pemerintah Kelurahan Pangongangan; tidak termasuk informasi yang dikecualikan.
  • Hasil keputusan Pemerintah Kelurahan Pangongangan dan latar belakang pertimbangannya;
  • Rencana kerja program/kegiatan, termasuk perkiraan pengeluaran tahunan Pemerintah Kelurahan Pangongangan;
  • Perjanjian Pemerintah Kelurahan Pangongangan dengan pihak ketiga;
  • Informasi dan kebijakan yang disampaikan Pejabat Pemerintah Kelurahan Pangongangan dalam pertemuan yang terbuka untuk umum;
  • Prosedur kerja pegawai Pemerintah Kelurahan Pangongangan yang berkaitan dengan pelayanan masyarakat; dan/atau
  • Laporan mengenai pelayanan akses informasi publik sebagaimana diatur dalam Undang-Undang Nomor 14 Tahun 2008 tentang Keterbukaan Informasi Publik.
  1. Informasi Yang Dikecualikan

Dalam pengelompokan informasi yang dikecualikan, perlu diperhatikan hal-hal sebagai berikut:

  1. Informasi yang dikecualikan adalah informasi sebagaimana diatur dalam Undang-Undang Nomor 14 Tahun 2008, Pasal 2 ayat 4, Pasal 6, pasal 17 dan 18.
  2. Prinsip-prinsip yang harus diperhatikan dalam mengelompokkan informasi yang dikecualikan:
  • ) Ketat, artinya untuk mengategorikan informasi yang dikecualikan harus benar-benar mengacu pada metode yang valid dan mengedepankan obyektivitas.
  • Terbatas, artinya informasi yang dikecualikan harus terbatas pada informasi tertentu untuk menghindari penafsiran yang subyektif dan kesewenangan.
  • Tidak mutlak, artinya tidak ada informasi yang secara mutlak dikecualikan ketika kepentingan publik yang lebih besar menghendakinya.
  1. Pengecualian harus melalui metode uji konsekuensi bahaya (consequential harm test) yang mendasari penentuan suatu informasi harus dirahasiakan apabila informasi tersebut dibuka.
  2. Untuk lebih menjamin suatu informasi dapat dibuka atau ditutup secara obyektif, maka metode sebagaimana tersebut pada poin c dilengkapi dengan uji kepentingan publik (balancing public interest test) yang mendasari penentuan informasi harus ditutup sesuai dengan kepentingan publik.
  3. Pengklasifikasian akses informasi harus disertai pertimbangan tertulis tentang implikasi informasi dari sisi politik, ekonomi, sosial budaya, dan pertahanan keamanan.
  4. Usulan klasifikasi akses informasi yang bersifat ketat dan terbatas sebagaimana dimaksud pada huruf b angka 1) dan 2) tersebut di atas, diajukan oleh SKPD yang memiliki kemandirian dalam mengelola kegiatan, anggaran dan administrasi.
  5. Penetapan sebagaimana tersebut pada huruf b angka 3) dilakukan melalui rapat pimpinan
  1. PENDOKUMENTASIAN INFORMASI

Pendokumentasian informasi adalah kegiatan penyimpanan data dan informasi, catatan dan/atau keterangan yang dibuat dan/atau diterima Perangkat Kelurahhan Pangongangan di lingkungan Pemerintah Kelurahhan Pangongangan untuk membantu PPID melayani permintaan informasi. Pendokumentasian informasi dilaksanakan sesuai dengan peraturan perundang-undangan bidang kearsipan dan peraturan di bidang tata persuratan yang berlaku di lingkungan Pemerintah Kelurahhan Pangongangan.

Tahapan dalam pendokumentasian informasi meliputi :

  1. Deskripsi Informasi:

Setiap Perangkat Kelurahhan Pangongangan membuat ringkasan untuk masing-masing jenis informasi.

  1. Verifikasi Informasi:

Setiap informasi diverifikasi sesuai dengan jenis kegiatannya

  1. Otentikasi Informasi:

Dilakukan untuk menjamin keaslian informasi melalui validasi informasi oleh setiap satuan Kerja.

  1. Kodefikasi Informasi:
  2. Untuk mempermudah pencarian informasi yang dibutuhkan, maka dilakukan kodefikasi
  3. Metode pengkodean ditentukan oleh masing-masing Satuan Kerja.
  4. Penataan dan Penyimpanan Informasi.

 

  1. PENYELESAIAN SENGKETA INFORMASI

Mekanisme Penyelesaian Sengketa Informasi:

  1. PPID yang akan menolak memberikan informasi publik yang tidak sesuai dengan ketentuan peraturan perundang-undangan, dengan prosedur sebagai berikut:
    • PPID mempersiapkan daftar pemohon dan/atau pengguna informasi yang akan ditolak;
    • PPID mengadakan rapat koordinasi paling lambat 3 hari kerja setelah surat permohonan diterima PPID;
    • Hasil keputusan rapat koordinasi dituangkan dalam berita acara yang ditandatangani oleh seluruh peserta rapat;
    • Hasil keputusan rapat didokumentasikan secara baik
  2. PPID yang akan memberikan tanggapan atas keberatan yang disampaikan pemohon informasi publik secara tertulis:
    • PPID mempersiapkan daftar keberatan yang disampaikan pemohon dan/atau pengguna informasi;
    • PPID mengadakan rapat koordinasi paling lambat 3 hari kerja setelah surat permohonan diterima PPID;
    • Hasil keputusan rapat koordinasi dituangkan dalam berita acara yang ditandatangani oleh seluruh peserta rapat;
    • Hasil keputusan rapat didokumentasikan secara baik.
  3. Penyelesaian sengketa informasi
    • PPID menyiapkan bahan-bahan terkait sengketa informasi;
    • PPID menyusun kajian dan pertimbangan hukum untuk disampaikan kepada Atasan PPID;
    • Pada saat sengketa informasi berlanjut ke Komisi Informasi, PTUN, dan MA, maka PPID Provinsi melakukan pendampingan hukum untuk penyelesaian sengketa informasi.

 

  1. PENUTUP

Keterbukaan Informasi adalah sebuah keniscayaan yang tidak bisa kita hindari. Untuk itulah sejak Undang-Undang No 14 Tahun 2008 tentang Keterbukaan Informasi Publik mulai diberlakukan efektif secara nasional yaitu tanggal 30 April 2010 atau dua tahun setelah Undang-Undang tersebut diundangkan, maka tidak ada lagi titik untuk kembali bagi Badan Publik Pemerintah maupun Badan Publik

Non Pemerintah untuk mengimplementasi UU KIP ini.

Selaras dengan Amanat UU No. 14 Tahun 2008 tentang KIP, semua Badan Publik berkewajiban menyampaikan dan membuka akses informasi kepada masyarakat.

Kita harus sikapi positif UU KIP ini, mengingat transparansi informasi adalah untuk kepentingan bersama dan bermanfaat bagi kita semua, baik itu sebagai Badan Publik Pemerintah maupun Non Pemerintah sebagai penyedia informasi maupun masyarakat sebagai pengguna informasi.

Untuk menuju suatu perubahan yang lebih baik, tentunya tidak terlepas dari berbagai tantangan, kelemahan bahkan perasaan kuatir bagi Badan Publik menjadi lebih transparan. Namun sebagai amanat Undang Undang bahwa Informasi menjadi kebutuhan pokok masyarakat, keterbukaan Informasi sudah menjadi konsekuensi Negara demokrasi .Oleh karena itu penyelenggaara Negara yang baik, keterbukaan informasi merupakan sarana mengoptimalkan pengawasan masyarakat atau publik terhadap penyelenggaraan negara.

Terkait hal inilah dipandang perlu untuk menyusun Pedoman Umum Pejabat Pengelola Informasi dan Dokumentasi (PPID), tidak lain adalah merupakan kewajiban Badan Publik melalui PPID untuk mengoptimalkan peran dan fungsi untuk menjalankan Undang Undang Keterbukaan Informasi Publik. Semoga melalui Pedoman Umum ini Implementasi Undang Undang Keterbukaan Informasi Publik di Badan Publik dapat berjalan dengan baik sesuai yang kita harapkan bersama sekaligus dapat memberikan kemudahan bagi masyarakat untuk mengakses Informasi Publik
