Daftar Informasi Publik Yang Dikecualikan Tahun 2024 Kelurahan Pangongangan DAFTAR INFORMASI PUBLIK YANG DIKECUALIKAN TAHUN 2023 KELURAHAN PANGONGANGAN DAFTAR-INFORMASI-PUBLIK-YANG-DI-KECUALIKAN-DI-LINGKUNGAN-KELURAHAN-PANGONGANGAN-2022 Informasi-Dikecualikan

Informasi yang dikecualikan tidak bersifat permanen kecuali Informasi Publik yang apabila dibuka dapat mengungkapkan isi akta otentik yang bersifat pribadi dan kemauan terakhir ataupun wasiat seseorang dan Informasi Publik yang apabila dibuka dan diberikan kepada Pemohon Informasi Publik dapat mengungkap rahasia pribadi (Pasal 17 butir g dan h UU 14 Tahun 2008). Tidak bersifat permanen artinya informasi tersebut dibatasi jangka waktu tertentu. Sifat tidak permanen juga dapat didasarkan pada keputusan dan ijin persetujuan tertulis dari Komisi informasi setelah sengketa atau mediasi atau pun karena keputusan pimpinan satuan kerja.

Penentuan informasi yang dikecualikan melalui prosedur yang disebut sebagai pengujian konsekuensi. Kegiatan tersebut dilakukan untuk menguji tentang konsekuensi yang timbul apabila suatu informasi publik diberikan kepada masyarakat dengan mempertimbangkan secara seksama bahwa menutup informasi publik dapat melindungi kepentingan yang lebih besar daripada membuka atau sebaliknya.

Pada Umumnya, uji  konsekuensi dilakukan atas informasi publik berdasarkan permintaan publik terhadap informasi publik selain yang terbuka. Hasil dari uji konsekuensi adalah informasi publik yang dikecualikan.

Uji konsekuensi dilakukan oleh PPID dengan melibatkan pejabat dari setiap SKPD. PPID dapat melakukan :

  1. Mengklarifikasi informasi yang dimohon. Dalam tahapan ini PPID meminta keterangan kepada pemohon informasi mengenai gambaran informasi, alasan pemohon dan tujuan penggunaan.
  2. Mengidentifikasi  dasar hukum pengecualian sesuai dengan pasal dan ayat dalam UU 14 Tahun 2008.
  3. Mengdentiifikasi tujuan penngecualian tersebut.
  4. Mengidentifikasi relevansi tujuan tersebut dengan pemohon informasi.

Dalam membuat daftar informasi publik yang dikecualikan, tahapan yang bisa dilakukan adalah sebagai berikut :

  1. SKPD mengumpulkan dan mengklarifikasi dokumen-dokumen yang bersifat umum dan khusus;
  2. SKPD memriksa dokumen-dokumen tersebut dan mengidentifikasi dengan merujuk tabel dibawah ini;
  3. PPID mengumpulkan informasi-informasi yang diusulkan dari setiap SKPD;
  4. PPID mengundang SKPD dalam pertemuan untuk membahas dan mengoreksi rangkuman dan kategori informasi yang dibuat oleh PPID berdasarkan data dari SKPD;
  5. PPID melakukan uji konsekuensi untuk informasi yang dikecualikan, dengan menggunakan formulir  sebagaimana tabel dibawah ini. Bilamana dirasakan perlu untuk memperkaya masukan, maka PPID dapat berkonsultasi dan berkoordinasi dengan beberapa kalangan yang memahami seperti akademisi dan praktisi.
  6. PPID mendokumentasikan seluruh hasil uji konsekuensi.

Jangka waktu pengecualian

  1. Jangka Waktu Pengecualian Informasi Publik yang apabila di buka dan di berikan kepada pemohon informasi publik dapat menghambat proses penegakan hukum di tetapkan paling lama 30 (tiga pulih) tahun.
  2. Jangka Waktu tersebut di kecualikan jika informasi public tersebut telah di buka dalam pengadilan siding yang terbuka untuk umum.
  3. Jangka waktu Pengecualian Informasi Publik yang apabila dibuka dan di berikan kepada pemohon informasi publik dapat mengganggu kepentingan perlindungan hak atas kekayaan intelektual dan perlindungan dari persaingan usaha tidak sehat di tetapkan berdasarkan ketentuan peraturan perundang-undangan.
  4. Jangka Waktu Pengecualian Informasi Publik yang apabila di buka dan di berikan kepada Pemohon Informasi Publik di tetapkan selama jangka waktu yang di butuhkan jika :
  • Dapat membahayakan Pertahanan dan Keamanan Negara
  • Dapat mengungkapkan kekayaan alam Indonesia
  • Dapat merugikan ketahanan ekonomi Nasional
  • Dapat merugikan kepentingan hubungan Luar Negeri
  1. Jangka Waktu Pengecualian Informasi Publik yang apabila di buka dapat mengungkapkan isi fakta otentik yang bersifat pribadi dan kemauan terakhir maupun wasiat seseorang di tetapkan berdasarkan ketentuan peraturan perundang-undangan.
  2. Jangka Waktu Pengecualian Informasi Publik yang apabila di buka dan di berikan kepada Pemohon Informasi publik dapat mengungkapkan rahasia pribadi seseorang di tetapkan selama jangka waktu yang di butuhkan untuk perlingdungan rahasia pribadi seseorang.
  3. Informasi pada poin (5) dan (6) dapat di buka bila pihak yang rahasianya di ungkap memberikan persetujuan tertulis ; dan atau pengungkapan berkaitan dengan posisi seseorang dalam jabatan-jabatan publik sesuai dengan ketentuan peraturan perundang-undangan.
  4. Jangka Waktu Pengecualian memorandum atau surat-surat antar Badan Publik atau intra-Badan publik yang berkaitan dengan informasi yang di kecualikan di tetapkan berdasarkan ketentuan peraturan perundang-undangan.
  5. PPID atas persetujuan pimpinan badan publik yang bersangkutan dapat mengubah klasifikasi informasi yang di kecualikan.
  6. Pengubahan klasifikasi Informasi yang di kecualikan hanya dapat di berlakukan berdasarkan pengujian konsekuensi.
  7. Informasi yang di kecualikan yang telah habis jangka waktu pengecualiannya menjadi informasi publik yang dapat di akses oleh pemohon informasi Publik dengan penetapan dari PPID dan dilakukan paling lama 30 (tigapuluh) hari kerja sebelum berakhirnya jangka waktu pengecualian.
  8. Dalam hal penetapan dapat dilakukan , informasi yang di kecualiakan menjadi terbuka pada saat berakhirnya jangka waktu pengecualian.
